Police: Man stole dead woman’s dog, took photos of her body after she overdosed

A man was arrested in Rochester for allegedly taking photos of a dead woman’s body and stealing her dog. 

According to Gates Police, a woman died of an overdose inside a Rochester-area motel on Oct. 20.

Jose Pena is accused of breaking into the room through a window and taking photos of her when he found her dead in the bed.

Instead of calling 911, police say Pena took photos of her body with his cell phone and took her cell phone to hide evidence. He also took the woman’s dog, officers say.

The woman was found three days later by housekeeping.

Pena has been charged with burglary, petit larceny and tampering with physical evidence.

He is being held in jail on $3,000 bail.

Police say the dog has been recovered.
