Orlando, F.L (NEWS10) – A Florida man is suing a doughnut company after police say the icing tested positive for meth.

The incident happened back in July when Dan Rushing bought a doughnut from Krispy Kreme and was in for a big surprise.

Rushing was pulled over by police for a speeding and got his car searched

When police saw dried icing on the floor of his seat, they assumed it was meth and arrested him on the spot.

After further test, the icing did test positive for meth two separate times.

Rushing was held in jail for 11 hours while they strip searched him and questioned him before being let go.

He is now suing the company who tested the icing saying they did not handle the situation properly, as well as Krispy Kreme for a defective product.
