Albany officer accused in Utica shooting incident appears in court

Albany Police Officer Chris Kitto appeared in court on Wednesday following an incident earlier this month in Utica.

Kitto, who was off-duty at the time, is accused of shooting and killing a man who tried to rob him.

Police say Kitto went to downtown Utica to meet up with a prostitute and that’s when the altercation happened.

Kitto was charged with soliciting a prostitute, which he has pleaded not guilty to.

He is not being charged with murder because the shooting was deemed an act of self-defense.
