SARATOGA SPRINGS, N.Y. – Police have arrested a man who allegedly stabbed his co-worker in the back at a restaurant on Broadway.

According to Saratoga Springs Police, officers responded to a reported stabbing at the Circus Case on Broadway.

Upon arrival, officers located the 34-year-old victim with a stab wound to his lower back. He was taken to Albany Medical Center for treatment. He is in stable condition.

Police say that shortly after, the suspect was identified as David Hernandez, 50. He was not at the scene of the incident.

An investigation revealed that Hernandez and the victim are co-workers at the restaurant. The two work in the kitchen together. Police say that prior to the assault, the pair had been in a verbal argument which escalated into an assault where Hernandez allegedly punched the victim in the face several times. He then allegedly took a 10 inch carving knife and stabbed he victim once in the lower back.

Hernandez then set the knife down and walked out of the restaurant, according to police.

"The service industry this time of year in Saratoga is jamming. Whenever you're busy it's stressful but to rise to this level of violence is concerning," said Lt. Bob Jillson.

Police were able to locate Hernandez in one of the parking garages near the restaurant. The suspect was taken into custody without incident.

He has been charged with assault in the second degree and criminal possession of a weapon in the fourth degree. Hernandez was arraigned this morning and remanded on $10,000 cash or $20,000 bond.

Police say that the incident did not affect any of the patrons in the restaurant as it was isolated to the kitchen area.
