BALLSTON SPA, N.Y. – A judge found a Ballston Spa man guilty of criminal sex acts stemming from a 2011 attack.
Eric Simmons, 52, was found guilty of Criminal Sexual Act in the First Degree, Sex Abuse in the First Degree, Assault in the Second and Third Degree and Criminal Obstruction of Breathing or Blood Circulation.
On September 5, 2011, a female acquaintance gave Simmons a ride home during a rain storm. Simmons directed her to a wooded area where he then pulled her from the vehicle and sexually assaulted her. The victim got away and reported the attack to police.
Police found physical evidence from the assault and attempted to locate Simmons, but he had fled the state. He was later found in Tennessee in 2013 and arrested as a fugitive from justice and extradited to New York State.
Simmons was found guilty by a judge after a six-day bench trial.
Sentencing is scheduled for 1:30 p.m. on August 26. Simmons faces between five and 25 years in whole or half years plus ten years of post-release supervision.
