Judge rejects Ark Charter School's request to stay open for summer


TROY, N.Y. -- A state Supreme Court judge has rejected a local charter school’s request to stay open for their summer program, while their legal case is pending against the state.

The battle to keep the Ark Community Charter School open has been going on for months.

The SUNY Charter School Committee voted 2-1 to not renew the Ark’s charter for next year, citing poor performance on test scores.

The school filed a petition in state supreme court in an effort to keep the school open. The state Supreme Court later issued a temporary restraining order to keep it open.

In June, a judge denied the state’s motion to dismiss the case. 

The Ark lawyers have argued, and right now their whole case hinges on this -- did one of the people on the state committee that closed Ark have a conflict of interest because she was formerly a trustee at a competing charter school in Troy, Troy Prep?

The state argues that only a handful of Ark students would even be eligible to transfer to the Troy Prep, and that they had a waiting list of 156 kids this past year.

The bottom line is Ark will close next Friday and will stay closed unless the court finds some wrongdoing by the state.
