BALLSTON SPA, N.Y. – The civil trial against Edward O’Rourke is expected to begin in Ballston Spa.
O’Rourke is the father of the 13-year-old boy who accidentally shot and killed 12-year-old Nicholas Naukin in 2010.
O’Rourke has pleaded guilty to charges of endangering the welfare of a child in March 2012. He is not expected to serve time in jail, but he must surrender his guns and submit a DNA sample.
Police say the father left unsecured loose ammunition in his home in December 2010. O’Rourke’s son was left alone with his friend, Naukin. The son found the unloaded handgun in a dresser drawer and a loaded clip in another drawer.
Authorities confirmed the boys loaded and unloaded the gun several times before it went off, shooting the 12-year-old in the head.
O’Rourke’s son was put on probation for two years and had to undergo counseling.
The trial is expected to start on Tuesday at 9:30 a.m.
