Former Cohoes High School student appeals decision in 2011 cyber bullying case

ALBANY, N.Y. — A challenge to Albany County’s cyber bullying law is being brought up by a former Cohoes High School student.

Officials said the then 15-year-old made a Facebook page called “Cohoes flame page” where he posted pictures of ten classmates along with derogatory comments and sexual references.

“Cyber Bullying” against any person in Albany County is a misdemeanor under local law.

Marquan Miggs, now 18, pleaded guilty to cyber bullying and was sentenced as a youthful offender to three years of probation. Miggs was the first person arrested under the law.

Miggs is now challenging the law, saying it is “unconstitutionally vague”. The New York State Court of Appeals heard oral arguments on the case Thursday.
