Halacy pleads guilty to second degree rape charge

RENSSELAER, N.Y. - John Halacy pleaded guilty to rape in the second degree on Thursday.

Halacy, 24, was in Rensselaer County Court at 9 a.m. He pleaded guilty to the charge and has been adjourned until August 5 at 10 a.m. according to District Attorney Arthur Glass.

Halacy is expected to receive four years in State Prison and three years of post-release supervision.  He will also have to register as a sex offender. An order of protection has been issued for all of the victims. 

The Rensselaer man was first arrested in February 2013 on rape charges against two girls, ages 13 and 15 years old. Those felony rape charges against him were dropped in November 2013 when a prosecutor failed to file a key document in the case. 

The charges were dropped due to a flub in paperwork, which was supposed to be filed by Laura Krueglar who handles sex crimes for the DA's office. However, the paperwork was never submitted. Krueglar resigned from her position a short time later.

Since Halacy's case was not presented to a Grand Jury in a timely fashion, his right to a speedy trial was violated, leading to a dismissal of the charges.

In late November, after his initial charges were dropped, Halacy faced five new misdemeanor charges in relation to the incident.

In December, two search warrants were executed at Halacy's Second Street apartment. 

The first search warrant was conducted by Colonie Police for Albany County Court in regards to a Thanksgiving Day burglary. Earlier in April, Halacy was sentenced to five and a half years in State Prison for his role in the burglary in the Town of Colonie. 

A second search warrant was executed by Homeland Security. However, officials have not commented on the nature of the warrant, but a number of boxes were removed from Halacy's apartment.
