State Police: Man drove with .29% BAC


CLIFTON PARK, N.Y. – State Police say they arrested a man who had a BAC more than three times the legal limit.

State Troopers in Clifton Park responded to a complaint on Ushers Road on Sunday evening. Around 8 p.m., police observed a vehicle driving accused an Ushers Road yard, causing damage to the lawn.

Troopers were able to catch up to the vehicle. Authorities say James Ouderkirk, 28, was found intoxicated. A breath test showed Ouderkirk has a BAC of .29-percent, according to State Police.

He has been charged with Aggravated DWI and Criminal Mischief 4th, both misdemeanors. Ouderkirk was released on tickets and is due to appear in court later this month.
