Halacy sentenced in Thanksgiving burglary

ALBANY, N.Y. – A local man has been sentenced to prison in connection to a Thanksgiving Day burglary.

John Halacy was sentenced to 5 1/2 years and three years post release supervision in court Thursday. A judge also granted an order of protection to victims.

On March 6, 2014, Halacy pleaded guilty to one count of Felony Attempted Burglary.

On November 28, 2013, Halacy, Andre Beverly, 18, and alleged co-defendant Raymond Halacy, 19, unlawfully entered a residence on Haswell Road in the Town of Colonie and stole televisions, computers, video games and guitars while inside. The occupants of the residence were not home at the time of the incident.

Shortly after, Halacy was observed on a closed circuit video camera selling some of the items at a store in Colonie Center. Two search warrants were executed at Halacy's 2nd Street apartment – the first by Colonie Police in regards to the burglary. Authorities say Halacy was in possession of some of the stolen items totaling nearly $10,000. The second search warrant was executed by Homeland Security. However, officials have not commented on the nature of the warrant, but a number of boxes were removed from Halacy's apartment.

During victim impact statements, one of the burglary victims took the stand and spoke about how Halacy's actions have affected her life. She said he stole 60 items, including her social security card and leftover prescriptions.

"The most telling instance that I heard from the victim was the fact that some socks she bought for the child she'd been carrying were stolen as well," said ADA  Eric Galarneau.

Halacy made headlines in November after rape charges against him were dropped due to a flub in paperwork. Since Halacy's case was not presented to a Grand Jury in a timely fashion, his right to a speedy trial was violated, leading to a dismissal of the charges.
