ALBANY, N.Y. – A man has pleaded guilty to driving with a BAC more than three times the legal limit.
According to officials, Alphonzo Hicks, Jr., 58, pleaded guilty to one count of aggravated driving while intoxicated, a felony.
On February 3, Guilderland Police officers responded to a call involving Hicks attempting to enter a closed and locked diner on Carman Road. Upon investigation, it was determined that Hicks was intoxicated.
The Troy man failed several field sobriety tests. After he was arrested, police found an empty bottle of vodka in his vehicle.
Upon arrival to the police station, a Breathalyzer test determined Hicks had a BAC of .27-percent. Police say they were unable to take a booking photo due to the man's intoxicated state.
Hicks faces one to three years in State Prison, the installation of an Ignition Interlock Device for 3 years following his release, a $1,000 fine and a minimum of 1 year of license revocation when he is sentenced in May.
