ALBANY, N.Y. – A Cohoes man has been sentenced to State Prison on Monday.
D.A. Soares said Walter Russell, 55, was sentenced to 1 2/3 to 5 years in State Prison after he pleaded guilty to one count of aggravated driving while intoxicated and one count of aggravated unlicensed operation in the 1st degree.
On December 6, 2013 on Central Avenue in Cohoes, police officers observed Russell's vehicle swerving to the extreme right and left of the roadway and almost colliding with several parked vehicles.
After initiating a traffic stop, the defendant failed multiple field sobriety tests and registered a BAC of .26% while in custody, according to authorities.
Russell has two previous felony convictions of Driving While Intoxicated that occurred within the last 10 years.
Russell will also be required to install an Ignition Interlock Device in any vehicle he owns for three years after he is released. He also faces a minimum of one year of license revocation from the New York State Department of Motor Vehicles.
