Man accused of driving drunk in fatal accident no longer police officer

EAST GREENBUSH, N.Y. - Mark Fusco is no longer a Rensselaer Police Officer, according to the city's Mayor.

The Police Chief's son, is charged with aggravated vehicular homicide. He is accused of driving drunk when he crashed his personal car into a tree on Third Avenue Extension last March.

His passenger, 22-year old Sean Murphy of Slingerlands, was ejected from the car and died.  

According to Detective Sergeant Matthew Breig, Fusco's BAC was above .18-percent.

Mayor Dan Dwyer said Fusco, the son of Rensselaer Police Chief Rick Fusco, is no longer on the payroll.

Dwyer could give no other details, calling the situation a "personnel matter".
