$29K in restitution collected from man convicted of food stamp fraud


ALBANY, N.Y. – County investigators, along with Department of Social Services and county attorney's office have obtained $29,111 in restitution from a merchant imprisoned in 2012 for food stamp fraud.

The repayment is occurring because of the work of county investigators and the implementation of the county's online foreclosed property auction in June. The process requires bidders to register and provide disclosure information. County review of bid prequalification data submitted by Ricardo Fabian, the former owner of New City Market on Clinton Avenue, led to further investigation by the county.  

Investigators learned that following a March 2012 guilty plea to a felony charge of Criminal Possession of Public Benefit Cards, Fabian had been required to pay $30,000 in restitution to the county. Once investigators determined that Fabian had sought to bid on foreclosed properties, the county reviewed his bank records and determined that he had the assets needed to repay the county in full.     

"This case and repayment of $29,000 shows that our investigators are working to make sure that people who commit fraud are prosecuted and fully repay what they owe the taxpayers," said Albany County Executive Daniel McCoy. "I am pleased that these county employees were able to work together to follow through to make sure that the county was made whole and that this individual was prevented from obtaining foreclosed properties."

The investigation was conducted by investigators and staff from the Department of Law, the Albany County Attorney's Office, Albany County DSS Welfare Fraud Unit, the District Attorney and Albany County Sheriff's Office.
