Cragsmoor man arrested for vehicular manslaughter


ELLENVILLE, N.Y. — State Police of Ellenville have arrested a Cragsmoor man for vehicular manslaughter.

Donald Fairweather Jr., 47, was arrested for felony Vehicular Manslaughter, two counts of Vehicular Assault, and Aggravated Driving While Intoxicated.

On September 25, 2013 State Police at Ellenville investigated a fatal automobile accident that occurred on State Route 52 in the Town of Shawangunk. After the investigation, it was determined that Fairweather, while operating his van, crossed the center of the roadway and collided head on with another vehicle, causing the death of the operato,r Vadim Mushtak, and serious injuries to his passenger Nadezhda Mushtak.

Fairweather's blood alcohol content was determined to be .19 percent.

The Ulster County district attorney's office charged Fairweather on December 31, 2013 and issued a warrant of arrest. On January 1, 2014 state police of Ellenville arrested Fairweather and brought him to Ulster county jail to await arraignment.
