Police: Man accused of killing passenger while driving drunk


GREENPORT, N.Y. - State Police announced Saturday the pending arrest of Nicholas Howard, 20, in connection to a fatal motor vehicle accident which happened early Friday morning.

According to police, there is a warrant out for the arrest of Howard on the charges of Vehicular Manslaughter in the 2nd Degree, a Felony.

Howard is accused of driving when he crashed him car, which was also occupied by 40-year-old Scott Fenoff.

A preliminary investigation revealed that Howard's pick-up truck was traveling westbound on Church Road when it lost control. The vehicle exited the south shoulder of the road, possibly rolling over several times before the vehicle was engulfed in flames.

Fenoff was ejected from the pick-up truck and succumbed to his injuries. Howard was taken to Albany Medical Center with non-life threatening injuries.

Following his release from Albany Med, Howard was turned over to his family, however, Troopers observed him operating a vehicle in an intoxicated condition. His BAC was .09% according to Police.

Howard was arraigned before the Town of Livingston Court on the DWI charges and remanded to Columbia County Jail in lieu of $10,000 cash bail. 

The warrant for Vehicular Manslaughter has been handled at Columbia County Jail. Howard is expected to appear in the Town of Greenport Court on January 13, 2014.

Police do believe speed is a factor in the one-car crash.
