Jury deliberations in Gary Waite trial to continue on Wednesday

FALLS, N.Y. -- The case against Gary Waite, a Glens Falls man accused of causing the death of
his 15-month-old, is now in the hands of a jury.

did not have enough information or evidence to prove beyond a reasonable doubt
that Waite didn't care about his son Jessie Smith.

maintains his innocence.
"It's been a huge
hurt to our family and I'm sure to his family too but our families have
suffered not only with Jessie's death but with this trial and he just he needs
to, they need to finally put him away and get this over with," she said. "The difficult part
about the whole thing is just not admitting to saying that he did this to
Jessie and owning up to it and taking the responsibility for it."
