ALBANY, N.Y. -- A man convicted in the aftermath of the
arson that destroyed the Old Saratoga Winners Nightclub will attempt to appeal
his case in New York's highest court.
The court of appeals will
hear the arguments of Akiva Abraham on Tuesday. Three years ago, Abraham was
sentenced to up to twelve years in prison for insurance fraud after the
abandoned club burned down in 2009.
Prosecutors also charged
him with arson, but the jury did not agree.
Abraham's appeal is based
on a claim there's not enough evidence to prove the fraud. It was alleged he
took out a large insurance policy on the building, shortly before it burned.
