SARATOGA SPRINGS, N.Y. - Gabrielle Giffords as well as Attorney General Eric Schneiderman will be at the Saratoga Arms Fair on Sunday.
They're highlighting that this gun show does background checks and has other rules and regulations, but some selling these weapons say there's a bigger issue.
Joe Aldano says he's been a gun dealer for 35 years and has performed hundreds of background or NICS checks. They are required at the Saratoga Arms Fair and every person that buys a gun gets a NICS number written on their receipt before leaving the show.
However, he says for incidents, like the shooting that severely injured former Arizona congresswoman Gabrielle Giffords in 2011, there needs to be more action taken for those denied after a NICS check is performed.
"There's still a loophole there that they're not doing their end," says Aldano, "You make me do my part but that's as far as it goes. Once it gets to that part it stays in my store. It goes in a file."
Aldano told NEWS10 ABC he is not required to report to local authorities if someone trying to buy a gun is denied, it's something he says he would to see Police follow-up with those who are denied.
"Yeah it does somewhat work but there should be another step where everybody works with the local authorities to say ‘alright he was denied what's going on here check him out'."
Giffords now has an organization pushing to reduce gun violence. On that organization's website it says "The state's model helps keep guns out of the hands of people who shouldn't have them, like criminals and the dangerously mentally ill without infringing on our Second Amendment rights."
Aldano stated "You need to check it out see why this persons trying to buy a fire arm. He could be an illegal person trying to purchase a gun. If he doesn't get it from me he's going to get it somewhere else."
On Sunday when Giffords is at the show, NEWS10 ABC will be there to get some answers about what their view is on how far these background checks really go.
