Drue trial to be held in Saratoga County

BALLSTON SPA, N.Y. - An appeals court has denied the motion to change the venue for the trial of Dennis Drue, District Attorney Jim Murphy said Friday; Drue's trial will go on as planned in Saratoga County.

Drue, 23, has been indicted on 59 counts including Aggravated Vehicular Homicide and Vehicular Manslaughter. He is accused of causing the December 2012 car crash on the Northway that killed two high school seniors from Shenendahowa, Deanna Rivers and Chris Stewart, and injuring two others.

Earlier this month, Drue's lawyers filed a motion to have the case moved out of Saratoga County, saying his client cannot get a fair trial there. On Friday, Murphy says the motion has been denied.

Murphy says Drue's blood alcohol content was over the legal limit at the time of that crash and that he was impaired by drugs. Prosecutors also say marijuana and drug paraphilia were both found in Drue's car.

The trial is scheduled to begin on September 30, 2013. Drue has pleaded not guilty.
