Man shot by officer indicted by Grand Jury for menacing


SARATOGA SPRINGS, N.Y. – A Clifton Park man has been indicted by a Grand Jury for allegedly menacing a New York State Police Officer.

Douglas Stewart III, 43, was indicted on One Count of Menacing a Police Officer and three counts of Criminal Possession of a Weapon.

Stewart is accused of intentionally causing a police officer to fear physical injury or death by displaying a rifle while the officer was on duty. The officer shot Stewart because he felt threatened after Stewart was told to drop his weapon.

The police officer was responding to a call about a domestic incident.  

The incident took place at Stewart's home on August 6, 2013.

He was originally arraigned in Clifton Park Town Court where he posted $50,000 bond.  Stewart was then brought to the Saratoga Hospital for treatment.  He also surrendered his passport. 

An arraignment date has not been scheduled.
