BALLSTON SPA, N.Y. - An illegal immigrant convicted of kidnapping and assaulting a woman in Saratoga Springs has been sentenced to 11 years in prison.
Antonio Lopez-Bautista was sentenced Monday in Saratoga County Court for the crime he was found guilty of committing in May 2012. A jury found Bautista guilty in May on five of the nine felonies he faced, including kidnapping, abuse and assault. He was acquitted of attempted rape and robbery charges.
Bautista was charged after he approached the 68-year-old female victim in the area of Congress Street and South Franklin Street in Saratoga Springs while she waited in her car for her husband to get out of work. Police say he pulled the woman from the vehicle and dragged her along the sidewalk. Bautista then repeatedly punched and kicked her as she attempted to defend herself and yell for help. A caller alerted police to what they described as a 'physical domestic incident.'
The attack was caught on surveillance, which jurors say helped in coming to a verdict.
The victim was not in court for sentencing, but wrote a letter she asked the judge to take into consideration when sentencing Bautista.
Bautista also wrote a letter, to the victim in the case, asking for forgiveness. In court he sobbed telling the judge he made a mistake because he was drunk at the time of the crime.
