Court: Wife of convicted arsonist can collect his pension
ALBANY, N.Y. -- A state
court ruling today will allow the wife of convicted arsonist Steven Raucci to
collect his pension.
The state appeals court
denied a preliminary injunction trying to prevent Shelly Raucci from collecting
the $5800 her husband receives in retirement allowance.
The justices found that
the state retirement law exempts pension fund payments from being garnished or
subject to legal processes.
They also recognized that
the so-called "Son of Sam" law which keeps criminals from profiting from their crimes
supersedes the retirement law, but a higher court ruled that could not be
factored in to the appellate decision.
