Troy City Council votes ‘no’ on porn district

TROY, N.Y. -- Troy's city council said no to establishing a porn district in an area of south Troy with a 5-4 vote Thursday night.

For years Troy has prevented new adult stores from setting up shop in the city by passing moratoriums, but some feared that set the city up for a potential lawsuit. Thursday's zoning decision would have allowed shops that sell adult DVDs, magazines, and sex toys to open their businesses in the south end of Troy.

Charlene Dobert was just one of dozens of people at the meeting who weren't happy with the proposal to rezone a 70-acre plot of stretching from Canal Street to the Menands Bridge, including the Rensselaer County Jail and numerous abandoned industrial sites.

"I don't know how they could think one community, south Troy, is not important," said Dobert.

City council members say for years there had been a moratorium on establishing an area zoned for adult businesses, and now is time to lift it.

"We cannot exclude these businesses from any of or towns or villages. They are allowed to be here," said council president Lynn Kopka.

Some council members say the area was chosen because the land is in bad shape and some of the old buildings can't even be sold.

"It makes it certainly more difficult to set up shop, but they are certainly able to do so," said Kopka.

The businesses would have to be 300 feet from homes and schools, but some say that's still too close.
