Man arraigned in hit and run accident that killed bicyclist


ALBANY, N.Y. -- A Schenectady man accused of killing a man when he hit him while leading police on a car chase was arraigned Thursday on charges of Murder, Manslaughter, Criminally Negligent Homicide, and Driving While Intoxicated.

According to police, in November 2012, 39-year-old Pablo Cruz was allegedly intoxicated and driving 25 miles over the speed limit when he ignored a cop car trying to pull him over.

Cruz then hit a bicyclist and continued to flee police with the victim still attached to the truck.

His attorney says while the event was tragic, there are many elements to consider.

"Obviously there are elements of this case that are very tragic, I don't know the circumstances and I'm not going to really speculate on what may or may not have happened or why what happened may have happened.  I think there are still a lot of questions about exactly what did happen and that remains to be seen," said Michael Feit, Cruz's attorney.

Cruz has pled not guilty on all counts and is in the Albany County Correctional Facility without bail.
