EAST GREENBUSH, N.Y. – A Rensselaer Police officer accused of causing a deadly crash while under the influence has been charged with Aggravated Vehicular Homicide, Manslaughter 2nd-degree, and Aggravated Driving While Intoxicated.
22-year-old Mark Fusco is accused of causing a drunk driving accident which killed his passenger 22-year-old Sean Murphy, of Slingerlands, on March 13th on Third Ave. Extension in East Greenbush.
Fusco is the son of the Rensselaer Police Department's Chief Rick Fusco,
and had recently been hired as a police officer with the Rensselaer
Police Department. He has since been suspended from the department.
Preliminary investigation into Murphy's cause of death indicate severe
blunt force injuries, resulting from the automobile impact into the
"The blood alcohol content was above .18. I can't comment on evidence that has not been presented yet to a grand jury on felonies, but the aggravated DWI charge is above a .18," says Detective Sergeant Matthew Breig.
Fusco was arraigned before East Greenbush Town Justice Mary Pat Donnelly Monday afternoon at Town Hall, and released on $10,000 bail. The case has been handed to a grand jury.
The delay in the arraignment occurred due to his hospitalization at Albany Medical Center Hospital with multiple injuries after the accident. According to Rensselaer County District Attorney Rich McNally, he was then moved from the hospital to a mental health facility where medical and mental health issues were addressed.
"There's witnesses, there's a total accident reconstruction, and photographs. A case like this takes time to put together and we want to make sure it's done correctly," said Breig.
Police have turned all evidence over to the Rensselaer County District Attorney's Office.
