Woman indicted on charges of murder, manslaughter in grandson’s death

SCHENECTADY, N.Y. – Gloria Nelligan, the Schenectady woman accused in the death of her grandson was indicted by a grand jury with one count of Murder in the 2nd-Degree and one count of Manslaughter in the 1st-Degree. 

In the murder count, Nelligan is accused of causing the death of Sha'hiim Nelligan, 8, by recklessly engaging in conduct that created a grave risk of serious physical injury or death to a child less than 11-years old under circumstances "evincing a depraved indifference to human life."  

In the second count of the indictment, Nelligan is accused of committing the crime of Manslaughter in the 1st-Degree when, with intent to cause physical injury to a child less than 11 years old, she recklessly engaged in conduct that created a grave risk of serious physical injury to the child and thereby caused his death.  Both of the charges are specifically intended to apply to the death of a child at the hands of an adult.

Sha'hiim's death was ruled a homicide as a result of hypovolemic shock and cerebral edema due to multiple blunt force impact injuries.  Through the investigation, it was revealed that Nelligan engaged in a prolonged and ultimately fatal beating of the child. 

District Attorney Robert M. Carney, noting that Ms. Nelligan was initially charged by police with the single count of Manslaughter, stated that "the Grand Jury heard evidence to support the additional charge of Murder based on a theory that Sha'hiim was subjected to a brutal and prolonged beating reflecting a wanton and callous state of mind so as to amount to torture, accompanied by a failure to provide the child with sustenance or timely medical attention."
