ALBANY, N.Y. – Timothy O'Connor, 30, was sentenced to 11 years in State Prison and 5 years of Post-Release Supervision in Albany County Court. He was also sentenced to 2 to 6 years in State Prison for violating the conditions of his participation in the Albany County Drug Court program. This sentence will be served consecutively to the aforementioned sentence.
On January 31, 2013, he pleaded guilty to one felony Count of Attempted Robbery in the 1st-Degree.
According to authorities, on Sept. 6, 2012, O'Connor entered a CVS on Madison Avenue in City of Albany brandishing a claw style hammer and stole money from the register. On Sept. 18, he returned to the CVS on Madison Avenue, displaying a note stating he had a gun and demanded oxycodone from the pharmacist.
Finally, on Sept. 19, he entered a Rite-Aid pharmacy on Central Avenue and handed a pharmacist a note stating he had a gun and displaying what appeared to be a pistol. O'Connor took a half ounce of oxycodone from this pharmacy.
"Prior to these actions, Mr. O'Connor had been given an opportunity at sobriety. While treatment is often the best course for defendants with addictions, we simply cannot accept the violence imposed on others as is the case here. Ensuring the safety and security of pharmacies that possess oxycodone and other controlled substances for legitimate medical purposes will always be a top priority in Albany County. The lengthy state prison sentence imposed upon the defendant is appropriate for the crimes he committed. I want to thank ADA Hauf for his hard work holding this defendant accountable for this actions and ensuring the safety and security of pharmacies in Albany County," commented DA Soares.
Assistant District Attorney Matthew Hauf of the Major Offense Bureau prosecuted this case.
