ALBANY, N.Y. (AP) - A midlevel New York court says 99 ballots should be added to the tally in a state Senate race where the winner appeared to have only a 37-vote advantage.
However, the contest in the 46th Senate District between Republican George Amedore and Democrat Cecilia Tkaczyk in upstate New York appears likely to go to the state's top court before it's finally sorted out.
The Appellate Division, ruling Wednesday, is directing county election boards to recount with those 99 ballots - 53 cast by Ulster County election inspectors and 46 other affidavit and absentee ballots - after concluding a judge incorrectly upheld objections filed by either party's lawyers.
The vote total certified by that judge in mid-December gave Amedore the win out of 126,000 ballots cast.
