ALBANY, N.Y. - Disenfranchised voters are continuing to speak out as an appellate court hears arguments on ballot counting in the 46th Senate District race.
After the re-count, Republican George Amedore was declared the winner over his challenger Cecilia Tkaczyk.
But there were still 331 ballots that were disputed - so they were never counted.
Now, voters are asking that those votes be considered and they are confident the court will agree.
"When you have a valid voter, who's legitimately registered, who's intentions are clear, the court tends to overlook minor technicalities that prevent people with legitimate votes from being legitimately counted," said Karen Sharff, Exec. Director Citizen Action of NY.
There is no word yet on when the court will make their final decision.
