LIVINGSTON, N.Y. – New York State Police are investigating a
one-car accident that left one man dead.
On Saturday, Dec. 31 at approximately 1:30 a.m., the NYS
Police responded to State Route 9 in the Town of Livingston for a 911 call of
an automobile accident.
Investigation at the scene revealed that a 2003 Toyota driven
southbound by Thomas Griffin, 19, of Germantown, N.Y. exited the roadway and
struck a utility pole. The rear seat passenger, Max Kelly, 21, of Germantown,
N.Y. was extricated from the vehicle by Livingston Fire Department and treated
by Northern Dutchess Paramedics prior to being transported to Albany Medical
Center with extensive injuries, in critical condition.
The operator, Griffin, was charged with DWI and Vehicular
Assault in the 2nd-Degree, a felony. He was arraigned in the Town of
Greenport and Released on his own recognizance.
Kelly later succumbed to his injuries.
The investigation into this matter is continuing with the
assistance of the Columbia County District Attorney's Office. Further charges
are anticipated.
