GLENS FALLS - An appeals court has reversed the conviction of a Glens Falls dance instructor on charges he sexually abused a young student.
The court says there were technical errors during jury selection.
The Warren County D.A. says she will retry 51-year-old Timothy McGuire for having sexual contact with the boy.
The appeals court threw out the conviction after saying the trial judge didn't properly question a potential juror about a bias against homosexuals, and mishandled a juror's question about what would happen if there wasn't a unanimous verdict.
McGuire has denied the charges.
