NY let guide keep license amid charges, complaints

ALBANY (AP) - New York kept the owner of Hudson River Rafting Co. among its licensed outdoor guides - despite two charges against him of reckless endangerment and a dozen citations of his guides for unlicensed whitewater trips.

That's because New York - unlike many states, the National Park Service and the U.S. Forest Service - regulates the guides themselves, not the companies.

This fall, an Ohio woman drowned on one of the company's Adirondack trips, and her guide was charged with criminally negligent homicide.

Owner Patrick Cunningham, who's taken thousands of clients down the Hudson, and guide Rory Fay denied the charges.

Their state licenses were suspended after the attorney general got a court order to temporarily shut down the rafting company.

The case continues.
