WESTERLO, N.Y. - A Greenville man died after striking a deer on Sunday at 1:30 in the morning in Westerlo.
The accident happened on County Route 408, nearby Johnny Cake Road in Westerlo, New York.
When Deputies arrived, they found an extensively damaged vehicle off of the roadway, in a deep ditch.
The driver of the vehicle, 45-year-old Timothy J. Webb of Greenville, N.Y. was located deceased in the vehicle.
Through investigation at the scene, it was determined that the vehicle had been traveling in a Southerly direction on County Route 408 when it struck a deer just South of Johnny Cake Road.
After the car hit the deer, it veered off the left side of the roadway, striking a tree and coming to rest down in the ditch.
Contributing factors are under investigation.
Speed does appear to be a factor.
During the course of the investigation, a portion of County Route 408 was closed.
Fire Police from the Westerlo Fire Department maintained road blocks at either end of the incident.
At approximately 2:25 am, a vehicle driven by 26-year-old Jeremy P. Lewis of Westerlo, failed to comply with the directions of Fire Police, and drove through the road closure, driving over flares around emergency vehicles and onto the opposite side of the road.
Lewis stopped when he drove up to a Westerlo Fire Truck which had been positioned across the roadway at the scene of the accident.
Deputies approached Lewis in his vehicle and immediately smelled a strong odor of an alcoholic beverage.
Lewis failed field sobriety tests at the scene and placed in custody for DWI.
He was processed at the Sheriff's Public Safety Building in Clarksville, where a breath test determined his BAC was .21%.
Lewis was charged with Aggravated DWI, a Misdemeanor, several vehicle and traffic violations and Criminal Possession of a Weapon in the Fourth Degree, as he was in possession of "brass knuckles" at the time of his arrest.
He was arraigned before the Westerlo Town Justice and remanded to the Albany County Correctional Facility in lieu of $10,000 cash bail.
