WESTERLO, N.Y. - On the second day of an investigation into the death of a 22-year-old man in Westerlo, Albany County Sheriff Craig Apple says it is now a confirmed homicide investigation.
Apple said Tuesday the body of 22-year-old Gabriel Philby was found with a stab wound to the chest and blunt force trauma to head.
The deceased body was found Monday morning by Philby's aunt in an apartment located above P&L Deli, located at 599 Route 143, where he lived with his mother.
Apple says Philby has been dead since Tuesday, the mother living there with the body until police arrived.
No charges have been filed at this time.
Evidence found at the scene by investigators led police to confirm the homicide investigation, Apple says.
NEWS10 has been told that Philby has Cerebral Palsy and lived in the apartment with his mother. Both are originally from Long Island and had been living in Westerlo since March.
Police say a call was made by Philby's aunt sometime Monday morning, when she was seen acting strangely outside of the apartment. Police responded, and that is when they discovered the body. The Sheriff's Department says they received no 911 calls regarding the incident prior to Monday morning.
The Sheriff says Philby's mother was brought in for questioning and has not been cooperative with investigators.
NEWS10 spoke with the owner of the building who said they were behind on rent were in the process of having them evicted.
