SCHAGHTICOKE, N.Y. (WTEN) - A Schaghticoke man faces arraignment Friday morning in Rensselaer County Court for charges in a drunk driving crash that killed his son and his son's girlfriend.
52-year-old Philip Dobert is charged with two counts of Aggravated Vehicular Homicide, and Felony DWI for the July crash that killed his son 20-year-old Kyle Dobert and his son's girlfriend 20-year-old Alisha Schoonmaker.
Police determined Dobert was driving drunk and speeding when he crashed into a utility pole on Route 40 in Schaghticoke.
Prosecutors are confident in their case against Dobert. Authorities say he had a blood alcohol level more than twice the legal limit when he crashed his car.
Prosecutors tell us he was coming from his other son's grave site and was driving at least 75 miles per hour in a 35 miles per hour speed zone when he hit a pole near the Schaghticoke Fairgrounds.
Dobert has been convicted twice before for drinking and driving. This was Dobert's second DWI conviction in the past ten years.
Dobert pled not guilty in court on Friday morning. He has been on house arrest the past two weeks, and is now being held at the Rensselaer County Jail with $100,000 bail. If convicted he could face up to 25 years behind bars.
