Mistrial declared in Troy attempted murder trial


TROY, N.Y. -- A mistrial has been ordered in an attempted murder case in Troy.

Judge Andrew Ceresia made the decision Tuesday after learning of a legal conflict between the defense attorney and some witnesses.

19-year old Ariel Myers was on trial for shooting Robert Guynup outside the Griswold Heights housing complex back in September.

Guynup was shot in the head as he tried to breakup a fight outside the complex. He used a camera to document the fight.

The mistrial was ordered because attorney Gregory Cholakis may have represented 2 of the witnesses in previous cases.

Prosecutors can retry the case.

Guynup had been in a coma for months following the shooting. He remains hospitalized.
